FEDERAL SCRUTINY: On April 10, 2026, the Department of the Interior's deadline to appeal a temporary injunction imposed by the U.S. District Court for the Eastern District of Virginia expired.
On January 16, 2026, a judge for the U.S. District Court for the District of Eastern Virginia allowed Coastal Virginia Offshore Wind to temporarily resume construction. The judge issued a temporary injunction against the Department of Interior’s suspension of the project’s lease. On December 23, Dominion had filed a complaint in federal court asking for the December 22 pause on construction to be lifted.
On December 22, 2025, the Department of the Interior paused the leases of five offshore wind projects under construction off the East Coast, including Coastal Virginia Offshore Wind, due to unspecified national security concerns.
